Is it legal? If the person is under the influence and does not know what they are saying. Is that confession legal?

I would ask the Prosecuting Attorney's office of your jurisdiction BEFORE finding yourself in a situation of taking a confession from an intoxicated person.

We typically do not interrogate a person under the influence. However, what they say is still admissible in court. Being drunk is not a defense to throw out evidence gained with contact from a suspect.

I am curious why a civilian would axe this question. Have you been charged with DWI? Odd question. I am suspicious.
