I am facing charges right now of felony "impersonating a public servant". The female who accused me of doing this I have only met once and couldn't even remember what she looked like.  I have also found out that she is friends with my ex girlfriend who I left after she attacked me for not agreeing to get her pregnant.


What exactly can I do. I have found several lies in her statements and her restraining order. My lawyer don't want to help much and is telling me to pleade guilty so that I can put this all behind me. I was offered a plee agreement that if I pled guilty that I would face one and a half years in jail all suspended and one and a half years on probation and that at the end if I stayed out of trouble they would reduce it from a D felony to a class A misdimeanor. This should never be on my record at all. call me please at (XXX)XXX-XXXX. I need to talk to someone and have a discussion on what to do. I am a former military police officer in the U.S. Army.

I have to agree with Jakesdad and TLeeworth. We are not lawyers. So if you have some issues that only a lawyer can help you with then you need to find another route to get the answers you seek.

I have to agree that you should pursue another lawyer in the event that there are discrepancies in the report. But I am reluctant to give a whole lot of other advice on a website such as this because this is not a venue that lends itself to verify much of the "facts."

I know you are not lawyers. That's why I joined. To talk to other LEO's. Not an attorney. The police should have investigated her accusations. not just turn it over to the D.A.

OK, check it out dude. You asked for advice. You got what you got. You're not going to get anything else from anybody else. Pretty much everybody here is going to tell you the same thing. Get another lawyer. Now, having said that, let me go back to being me. What on Gods Green earth are you thinking putting your telephone number on a forum that anybody in the world can read? I would think that as a Soldier, and even moreso, an MP, you'd have a little more common sense, and a broader awareness of OPSEC, and PERSEC. Are you farmiliar with those terms? If not, you may want to attend Basic Training again. I think they pretty much cover the basics during Day 3 or so. Also, you're probably not going to get to this point, but I feel it bears mentioning. The first thing we typically do here is post an Introduction, and then kinda ease our way into things. Granted, when I joined, I kinda stormed in, and made myself known, but not before I posted an intro. And not everybody is as charismatic as I am. Now, you may feel free to post something derogatory about me, and/or my heritage, and take your ball, and go home. I'd take my number down first if I was you. Some folks on this site spend a lot of time on the phone.

According to your post, you've already been charged and given a plea deal. Just from that information, it is already out of Law Enforcement hands. Hence the advise to fire your attorney and get a new one. That's the only advise (most likely) that you will get here.

Skylor, you should never put your phone number on an Internet site for, not only PL members to see, but others as well. That is just bad news for obvious reasons. You could have just asked someone to PM you. Also, I don't think it would be wise for anyone here to give you advice on what you should do. If someone here gave you the wrong information, God forbid, that someone could potentially find themselves in harm's way. The information you have posted on this site should be between you and your Lawyer. If you do not think your Lawyer is not doing you justice, find yourself another Lawyer.. a Criminal Lawyer, perhaps. If you have a Criminal Lawyer at this time, find someone else if you are not happy; but you need a Criminal Attorney, not a General Attorney.

You say the Police should have investigated her accusations, well I am going to have to assume that a Detective assigned to the case did investigate or is investigating. But, of course, reading this, one has to assume a great deal, don't they!

Skylor, One other thing, when the police investigate a case, we often are lied to, but unless we have proof at the time that the person is lying, we just take the information and leave it to the courts to determine who is lying and who is telling the truth. In situations like yours, usually all the parties shade the truth to some extent, some parties more that others. Once we turn our report over to the prosecuting attorney, we are done with our part of the incident, our next involvement would be testifing in court. Once again, we will testify as to what we were told and witnessed, which may bear scant resemblence to what really occured. Listen to BSL1123, he knows what his is talking aobut and is a good source if information.

Every cop knows there's three sides to a story: 1. The complaintant's version, 2. The suspect's version, and 3. The TRUTH!

It sounds like there was enough evidence to charge you. Now it is up to the court system to determine if the charges are susbtaniated. LE can't do anything further for you at this point.
