 Not really on the drugs themselves as much as what they are held in...here is the situation:


 


I bought a car from someone i work with, my sister and her kids and husband moved in with me, i then went out of the country, when i came back i was told my brother in law had been pulled over in the car i bought, the police found narcotic painkillers in a baggy, which were not prescribed to him or my sister or her kids, as well as prescriptions belonging to my sister and my niece. He is being charged with possession of a controlled substance for not only the pills in a baggy, but also his wife's pills and his step-daughter's. 


I asked the guy at work about the pills, he had a prescription for them, he kept them in a baggy in the car so they were easy to get too. He is concerned that if he testifies and says they were his and he left them in the car when he sold it that he will get in trouble for taking them out of the bottle and placing them in the baggy....is there a law against putting your own pills in a different container than a prescription bottle?

Yes there is. Some folks put mulitiple pills in the same bottle which is also a no no.

The drugs store sells containers specifically for pills that are marked Sunday - Saturday for people who take prescriptions on a regular basis.  Some of the containers are not even marked with the days of the week.  If the actual person who put the pills in a bag has a prescription for the medication, then they will simply have to prove that and SHOULD prove that. 


What I believe to be true is the following:  The Officer has no way of knowing that those pills were not his since they were not in a prescription bottle, therefore, when the Officer found the pills... there was no other choice put to cite your family member... he/she was doing their job.   As far as the pills with actual prescriptions owned by your other family member, I am unsure why they were taken away unless they two were in a non-labled prescription bottle. 


This can all be settled in court, but the person with the narcotics needs to step forward or be taken to court to testify on your family member's behalf.

I actually just saw this happen last night.  The subjects were being (detained/questioned? which one is the right term, I don't know yet.) for marijuana and indecent acts in a parking lot.  In the car were some different pills w/ no bottle.  I totally see why this is a law because there is no way to know if they really do have a presciption without the label on the bottle, and also I think it's because they were unidentified in just a clear bag,  the only ID being what the guy said they were.


 


p.s. I realize that I probably will call things by the wrong name or term, sorry.  But I definately do not mind being corrected.

Is it possible that the Bro-in-law had drugs that weren't his? Just food for thought.


It is against the law in every state that I know of to carry prescription drugs in any container other than the one they were issued in by the pharmacy. This is specifically to keep people from having drugs they're not supposed to have. Your choice is to strong arm the original owner to fess up ( which I DO NOT reccomend) or you can ask him nicely, and tell him that he will be turned in if he doesn't fess up. The punishment he will get for not having the drugs in a marked bottle (If he does indeed have a valid prescription) is a  slap on the wrist. I have found narcotics in an unmarked bottle before, and the person showed me a valid prescription for the drugs. It was an elderly gentleman, and he had a hard time with the childproof bottle, and wasn't aware that they provided easy open bottles for seniors. I simply informed him about the bottles, and sent him on his way.

For what it’s worth, here is some advice I was given by my doctor eons ago concerning this during a long recovery from a medical procedure and had several prescriptions; chiefly dealing with the narcotic painkillers and refills etc.


I was taking Lortab and later Ultram.
1.       Prescriptions are dispensed in labeled containers for a reason; keep them that way.
2.       Keep your medicine AT HOME in an appropriate location. ALWAYS.
3.       Do NOT carry around a full prescription bottle of your medicine with you (say, in your purse). Keep it at the house, in your medicine cabinet, safe deposit box, whatever. You don’t need the entire bottle for one day. There is a chance that someone may find out and steal them or, say you accidentally leave your purse or bag at a restaurant and it is never found. Two bad things there: First, some pill-popper is getting high off your medications and second, if it’s a controlled substance, you are SOL on a refill for a certain length of time regardless of the circumstances. Sucks to be you.
4.       If you have REFILLS: Keep the old empty prescription bottles at the house. When you get your refill, go home and put all but your daily dose of pills in the old bottle and put the daily pills in your new one to keep on you. That way, you won’t be screwed should something happen to the bottle AND the medication will be in its correct container should it be found by police or whomever. Also may come in handy in a medical emergency where such information is needed.
5.       To be safe: Keep the PRESCRIPTION RECIEPT in your wallet. All Rx’s (around here anyway) have TWO of those little perforated customer receipts you can tear off and toss in your wallet. (One for the home and one for the purse.) They are identical to the label on the bottle.   Takes 2 and half seconds to tear it and put in your purse/wallet. 
6.       Finally, do not play musical prescriptions with friends/family. No switching, sharing, trading, bartering, thieving, or taking meds that ain’t your own. Before you do that, stop and ask yourself: “Did I go to medical school?” If the answer is no, go find someone who did and talk to them.
 
Like I said, just a little advice from the pro (my doctor) for reference.

FYI, the whole thing is dealing with Narcotics. If I find you with Motrin, or Heart medication in a "pre dosed" container I'm not gonna hassle you, and any Cop that does is very bored. WE are trained to recognize what narcotics look like.

Hmm, I'm trying to find out what to do about my poor girlfriend.


She's a really good person, 20, just starting life and we got terry stoped in New York State.


She was raped as a virgin and decided to carry a stun gun that was given to her for her protection. She didn't know (neither did I) that since 9/11 you are not allowed to protect yourself from rape with a stun gun anywhere except your house.


They confiscated the self defence device and are charging her with a misdemeanor.


She also had HER meds in her perscribed pill bottle. But she was visiting me so she threw one of her Klonopin pills that she is perscribged by her doctor in her pill bottle because she was traveling. They are trying to get her for a misdemanor for that also.


Common sense tells me that she should get a warning for either of these offences... instead they want to give her a year of probation and want up to $1000 per offence!!


I'm afraid these offences will prevent her from getting a good job when she's out of school. She weighs under 100 lbs. Her intent was not to break the law, it was to protect her self from rape, and to take her own meds that she was perscribed.


I know the common response is - it's her falt for not memorizing every law in the state, but we know that they don't teach people how to be police officers or lawyers in highschool. Maybe they should.


That being said, I've been trying to find any helpfull information about this odd law to help her.


Can anyone help? Is there any place I can find the exact wording of the law that is being used against her for New York state?

  I'd have to first have a heart-to-heart w th Bro-law (as some others have already mentioned.) If he is on the level then the Friend is SOL. I would then have the friend meet with you or whoever has jurisdiction for where it occured and show the bottle with his name on it for the pills he claims to have placed in the bag. No bottle? then a note from his doctor as to the fact (or not) that he is on this med. It could just be the friend IS on drugs he isn't supposed to be; or making a little money on the side.


Also; a word of advice:


I can't get out of bed if I don't stay on my meds. 100mcg fentanyl and oxy codone for break through. etc.  I guarantee you that every month when that Fed-Ex pack arrives, the meds go directly into my Gun -Safe.


I also carry a piece of the cardboard box that the Fentanyl patches come in on the inside  of my wallet just next to my Driver's License. I have never worn hand-cuffs except in training; & I sure don't want to start now.
