Posted almost 3 years ago A Bismarck man faces two charges after allegedly pointing a gun at a deputy who was investigating a speeding complaint. Jesse McLain, 26, was charged Friday with Class C felony possession of a firearm by a felon and Class A misdemeanor reckless endangerment. South Central District Judge Donald Jorgensen set bond for McLain at $3,500 cash during a court hearing on Monday. The bond has been posted. According to an affidavit from Burleigh County Sheriff’s Sgt. Steve Hall, Deputy Dustin Braun, dressed in full uniform and driving a marked sheriff’s department vehicle, went to a home southeast of Bismarck to investigate a speeding complaint. He heard a person walking toward the door and heard the sound of a shotgun action being cycled, the affidavit said. He moved away from the door, saw the barrel of a shotgun sticking out the screen door, and drew his duty weapon. The affidavit said Braun identified himself as a law enforcement officer and ordered the person holding the gun, later identified as McLain, to drop it. “McLain continued to confront Braun, telling Braun to drop his gun first,” the affidavit said. “Braun continued to order McLain to drop the gun and did get McLain to exit the home without the gun.” McLain labeled the incident a “misunderstanding” in court on Monday. According to court documents, Braun is a convicted felon due to a Ward County conviction for theft of property. |
