Was this worded correctly by the Tribune? I know there are McLean guys on here to clarify. Please do, cus when I read this, it sounded like the gunman should've been shot and it would've been completely justified. Thanks and stay safe!

From the Bismarck Tribune:

A McLean County man has been charged with terrorizing for allegedly pointing a gun at an officer.

Daniel Paul Iglehart was charged Tuesday with the Class C felony, along with Class C felony assault on a peace officer and Class A misdemeanor preventing arrest or discharge of other duties.

According to an affidavit from McLean County Sheriff’s Deputy Sylvin Brunsell, officers responded to a McLean County farm at 8:37 p.m. Saturday for a report that Iglehart had been drinking and brandishing a weapon. Upon arrival, they found him slumped over in a Chevrolet Impala and a handgun was sitting next to his right leg.

The affidavit said Iglehart would not follow officers’ commands after they woke him up, and when an officer opened one of the car doors, Iglehart allegedly pointed the handgun at him. The officers backed off, and other officers arrived to assist. An off-duty federal officer who is a friend of Iglehart called him to get him to surrender, but it was not successful. The officer said Iglehart told him he wasn’t going to surrender and he wanted law enforcement to shoot him, the affidavit said.

After attempts at talking to Iglehart failed, the officers broke the driver’s side window of the Impala and simultaneously used a Taser on Iglehart. When that didn’t seem to work, they deployed another Taser on him. Officers took away his gun and arrested him.

Two deputies reported being kicked during the arrest, the affidavit said.
