Hello everyone,


Was wondering if all of you or a few of you could help me with a paper. I am probably over thinking this but, it’s on Mala In Se & Mala Prohibita. What I am having troubles with is identifying the eight major crimes used by the FBI in its crime index. Besides the obvious of homicide, white collar, & organized crime, what are the others ones? 


Would this also include Cyber Crime, Major/Thefts and civil rights? 


Just asking to point me in the right direction. I need to know these so that I can decide which crimes are considered to be Mala In Se or if they are Mala Prohibita. Please do not tell me which ones are which I need to figure that out on my own...

The eight crimes reported in the UCR that the crime index is derived from are:


Murder, Forcible Rape, Robbery, Aggravated Assault, Burglary, Larceny-Theft, Motor Vehicle Theft and Arson

Okay a little bit more help.


Murder, Forcible Rape, Aggravated Assault are considered Mala In Se


Robbery, Aggravated Assault, Burglary, Larceny-Theft, Motor Vehicle Theft and Arson are considered Mala Prohibita.


But all these are considered crimes and are prohibited by law, which would make them all Mala Prohibita. But thinking about it Mala Prohibita is more for crimes that are misdemeanors for say and crimes that are considered felonies such as murder would be Mala In Se.


Right?

For the purposes of the UCR, Murder, Forcible Rape, Robbery, Aggravated Assault are classified as Violent Crimes - Mala In Se (wrong or evil in itself) usually offenses against conscience (considered wrong by nature).


Burglary, Larceny-Theft, Motor Vehicle Theft and Arson are classified as Property Crime - Mala Prohibita (wrongs or evil prohibited) conduct that is prohibited by laws, although not inherently evil (wrong by prohibition).


The distinction between the two classifications is not always clear, crimes Mala In Se are usually those dangerous to life or limb.

 Clover  Mala in Se is very vague to describe, but as I was once told if it is against the law reguardless of what country you are in then it is Mala in Se. ie murder, theft, rape
