A man who pleaded guilty to a shooting spree that killed a Fremont County sheriff's deputy in 2001 has lost one bid to reduce his sentence, but he is still challenging his murder conviction. Joel Stovall argued at a hearing in September that his sentence to life, plus 896 years in prison was illegal, but a judge disagreed in a ruling Wednesday.

Stovall and his twin brother, Michael, were 24 when they pleaded guilty in November 2001 to one count of first-degree murder, 18 counts of attempted first-degree murder and one count of aggravated robbery after a shooting spree Sept. 28, 2001. The spree killed sheriff's Deputy Jason Schwartz, partially paralyzed Florence police Cpl. Toby Bethel and wounded a third officer.

Schwartz, 26, was trying to take the brothers to jail after a dog was shot and killed in Penrose. Authorities said Michael Stovall used a key to remove his handcuffs, then shot the deputy with two handguns hidden in his pants. Police said the brothers stole a pickup truck in Florence and fled, injuring Bethel before their arrests the next day.

Joel Stovall argues that his guilty plea was improperly coerced by his defense counsel. His challenge of his murder conviction is pending.

They should have, but Deputy Shwartz's wife was opposed to the death sentence so they got life plus 896 years,

I find that I must agree that a sentence of Life + 896 years is a bit excessive......................why should the taxpayers be forced to support this POS for the next 900 years or more..........if he wants the sentence reduced, then reduce it.........EXECUTE him TODAY!..........Electric Chair.....EXTRA CRISPY.....................or better yet.......death by Crockpot...........cook him nice and slow so he pays his debt to society and to the families of the officers that he so callously assaulted.

Death penalty takes too long and too costly for tax payers. Just take this POS behind a shed and be done with it.

I guess we should all feel sorry for their long prison stay. Have we really forgotten about the death penalty in this country? Why are these two alive?

First off, the death of Dep. Schwartz is tragic and saddening to say the least. The other two Officers have to deal with their partners death every day which is also equally as sad. Although Pissed that this POS is even trying to get a reduction, one of our jobs as LEO's is to learn from our mistakes and the mistakes of others. This guy had, not one but two, guns hidden in his pants. Thats a constant reminder to us that a thourough search is critical when dealing with these scumbags. A handcuff key was also missed. Now off of my training rant......

Dep. Schwartz's wife is opposed to the death penalty. So what......The Judge shouldve fried these two A-holes the same day! I cant beleive this guy is asking for a reduction in his sentence. Fine, we will take off 12 minutes for the time it took you to file your appeal. Theres your reduction. An Officer should have had the best of this guy when the shooting started and saved the tax payers some cash. I hope you rot in Hell you sick SOB. God bless Dep. Schwartz for giving his LIFE to Protect and Serve. We will NEVER forget!

I'm all for reducing the time this dirtbag spends in jail.  How about reduce his sentence to time served and then immediately execute him?  Or maybe reduce it to community service:  Bury his body in the city park and let him fertilize the flowers?  Good thing I'm not in charge, he would have been executed before he had time to make an appeal.  JMHO

This asking for a reduction in sentence is just wrong from every angle.

They should cut his sentence immediately, by releasing him from this mortal coil...put one in the back of head. No more time in prison, no more cost to the taxpayer, no chance this POS will get out one day.

When considering the law we must accept it in its full capacity. We may not agree with it, but the interpretation must be followed to the letter and spirit. I can't be bias because of what occurred, however there are some weak points in the conviction(s).
