Im an armed security officer on a military installation and was terminated supposedly under the IRP for dishonest behavior when all i did was tell the truth about an incident.  The investigation they are doing is a joke and everyone knows it. The union that we belong to is pretty much useless because the response we received was you can't win going against the government.  I did nothing wrong but noone cares.  I need to clear my name but how do i go about doing this, its me against all of them.  Virginia is a right to work state and we are contract security but we have a collective bargaining agreement.  Am I still entitled to due process. Can anyone offer me advice.

I can relate to what you're going through. Not at work but in other places.

You can try talking to a lawyer specializing in employee law.  But if your state is like Louisiana,  employment at will, there is not alot you can do.  The lawyer may be able to get them for slander....the theory...is that any time you go on an interview or have to repeat the facts of your termination, you have to slander youself.  I went through something like this when I was terminated from a hospital for reporting the SEVERE abuse and neglect of a 93 year old woman...I pissed the doctor off...and was let go not long after....Hope things get better for you...Melinda

I can relate to it too.....  almost too well.   as I am also in Virginia, and in a way, been there, done that, and gave the T-Shirt back.


 


Get a lawyer - find a lawyer you know and trust and get them to recommend an attorney who is the "sharkiest" and most respected labor representative in your area.


 


"at will" or "at whim'  same difference...   sometimes they just don't want to know the truth.

I hear you... my fiance ended up getting fired cause he ratted out his Captain who had been doing some- we'll just say innapropriate- things.  This was a private security company mind you.  The owners reprimended (sp?) the Captain, put him on suspension for a couple weeks, and had it put on his record.  Well, sure enough when the Captain came back, he drummed up some crap that my fiance wasn't doing his job.  So the Captain suspended him for 2 weeks.  Oh gee, that wasn't out of vengence? 


And THEN when my fiance came back, the Captain told him he was only going to give him 2 days a week.  Are you kidding?  These armed security guys- who worked mainly in GANG areas- got paid only 8 bucks an hour to risk their lives, but they did it anyway.  My fiance got jumped by a group of them- twice- and ended up getting 3 of them detained for the cops to show up and take them to jail.  So the Captain wants to cut it back to 2 days a week... when he has to drive 45-mins to get there, and another 45 to get back. 


My fiance said "You know that it's not even worth the gas money to go work only 2 shifts a week..."  And the Captain just said "Yup, I know."  So my fiance had to walk away from the job.  A month later they finally fired the Captain... but already he took out my fiance, my best friend, and another one of our buddies (they were all working there), plus a couple other REALLY good officers.  And the company wonders why NONE of those officers would come back when they called and asked them to after they fired the Captain.  Heh, it's a joke.  I say fight it as much as you can man.
