How many states now have out lawed talking on the cell phone while driving? Texas has not at this time made it illegal.... Recently my spuse was stopped for having her cell phone next to her ear not even talking on the phone, but just holding it next to her ear and she was stopped by an offcier who advised her that it wwa illegal to talk on the phone while driving. Well little did the officer know that when she told the officer to hang on just a minute that she was calling me (while I was on Patrol about 40 miles north of her). my wife then proceeded to ask me if it was illegal to drive and talk on the phone at the same time... I then advised her that the law had not been passed yet. The officer then asked who she was speaking to and she advised him that it was her husband, that was a police officer. he than advised her that he stopped her for speeding ..... he stated she was doing 65 MPH, I then asked her where she was.... where the officer had stopped her the speed limit was 65 MPH. I told her to tell him to go ahead and write the ticket and we would see him in court....

In Texas the only thing they have passed dealing with cell phones is teenage drivers. I am going off memmory but I think a driver under 18 can be cited for driving and talking on the cell phone. Dont quote me on the age you may want to look it up though.

All I can say to this is GET A HANDS FREE SYSTEM, weather it’s an ear piece or it’s built in your car... That is your best bet...... I SO DISAGREE WITH talking on your phone while you are driving.... I do not and DON’T

DC outlawed it... i've been wanting VA to do it butttttttttttttt... because most of VA is country, and it's NOVA that should have it banned, it's a no go apparently...

I work for a law office. I am 25 years old and I have been one to talk and drive... up until I reviewed a case recently about a 25 year old female who was talking on her cell phone and driving down a city street when she crossed the center line and hit a man head on. He was pronounced dead. She was charged with neg. hom. which in our state is a misdemenor.. I was kinda shocked to learn that. We currently do not have a law passed here in our state but hopefully we will soon.

This is terrible but should not happen as much as it does.

Cops live on the nextel or cell phone. My agency banned while drving and u must be in a private area to talk when stopped. Do they do it?

Virginia does not have a law yet for banning cells while driving unless(I think) under 18 years old. I think if they did pass a law banning it completly would still use the reckless driving code. If anyone in DC has charged anyone under the cell phone ban I would like to hear how the case(s) went. I can hear thier defence now "I just had it to my ear and not talking"

Its illegal in Chicago, but you can talk on the phone anywhere else in IL. $50 first time offense, and can go up to $200 if you were on the phone and caused an accident.

Legal in PA, I know we track cell phone useage if involved in a traffic crash as far as a contributing factor but thats it

you are required to keep your hands at two & ten o'clock when driving a automobile. if one hand is not on the steering wheel and you are having trouble keeping your car operating in a safe and efficient manner then it can be considered "careless driving", in extreme circumstances it is" reckess driving".

Law or no law, It is a dangerous distraction, I have a "hang up and drive" bumper sticker and that's just what some of these people need to do. They are so engrossed in their phone conversation that they are just driving on autopilot. It should be a law in all 50 and should carry a stiffer penalty if cell phone and accident are in the same time frame. Stay Safe

I think I need a hang up and drive sticker on my car! Along with the law actually being passed here. Hopefully it will be soon. The worst thing would be text messages, I mean technically you wouldnt be able to tell if someone were to text because the phone is usually held lower. When sending a text message they arent paying any attention to the road. We have had a huge amount of wrecks here in OKC over that as well. Like I was saying earlier with the Neg. Hom. charge being a misd. here the girl bonded out on 1,000 bond. She still is in court over it. Has not spent more than a day in jail. I just think that her punishment should be bigger and not considered something that does not even go on your record. She killed a man being neg. But guess you cant change the system. I have people that have P.I charges that have a bond set at 10K WTF.. our crazy system. Oh by the way.. WASTING MY TIME HUH.. thanks .. greatly appreciated.. just as I was starting to tell people how great this site is......

In CO there isn't a law yet, but like everyone else, there should be. I was behind this a-hole the other day who was talking on his cell, eating lunch, and driving a stick shift! At first I thought the guy was DUI but then I started watching his hand actions (thank God he wasn't doing that too). Seriously, this guy was bouncing back and forth between the lines like he was dodging mines. Not good....

Maryd has a good point, text messaging is more hazardous than talking on the cell phone. I admit, i've found myself texting and driving at the same time and it was no easy task.... Maryd, lighten up i was just kidding!

Mississippi passed a law about 2 yrs ago making it illegal for municipalities or county supervisors to pass ordinances restricting cell phone use in a motor vehicle.........go figure.

I definitely text and drive at the same time more than I talk on the phone and drive. Although I am very good at multi tasking and I'm a really good texter, I know it's dangerous and I really shouldn't do it. Vermont is in the process of passing a law banning cell phone use while driving. It shouldn't only be "talking" on the phone.

And as for Jimp, good luck to you and your wife. Sounds like the officer was just being an ass and messing with the wrong person.

I can't see a wide adoption of no cell phone laws... If they do start passing them though, I'd like stock in blue tooth headsets, for sure.

All the cops I know use their cell phones constantly while driving, talking to supervisors about calls, calling other responding officers to discuss things too winded for the radio, ect. Me personally, I use a head set, but still..... As big a thing as cell phones are now, I wouldn't make laws against them. It's not the phone's fault, it's the driver.

Bad driver's get easily distracted, good ones don't. that's what I think anyway.

I agree, acey. People can't blame the cell phones at all. When someone gets behind a wheel they automatically are responsible for anything that happens while they are operating that vehicle. Handsfree devices are a great idea. I know officers who call their wives often during their shift even if it's just for a couple minutes between traffic stops.

its illegal to talk and drive on all federal military installations now, here on Fort Carson its a $75.00 fine and 3 points, you have to use a hands-free device, its also illegal in New Mexico.

When we were visiting Eglin AFB in Florida last year we had to sign our visitors pass acknowledging hands free only or it was illegal.
