Given the anemic details (Driver) from the opinionated Pennlive blog that links in news articles from FOX', I 'm not ruling IN a hate crime(as yet), so I would have to lean on ruling it out until the facts play out.

Oh and as a response to the original question, heck yeah it's fair. If the government goes after one demographic for alleged hate crimes then under our illustrious 14th Amendment, all groups of people are fair game for the same thing.
Let me guess, you didn't read the article. The funny thing is, I rarely if ever watch television, just not my thing. I don't form an opinion based upon what some talking head thinks. When a group of black men beat a white man into a medically induced coma I suppose they did it for a justifiable reason......or could it be because of the color of his skin? As stated before, if the roles were reversed the NAACP and Eric Holder would already be there. This isn't a left or right thing, this is an open your eyes thing. In your opinion what is the justifiable reason for this group's actions?

The Police are investigating all aspects, so I take the position and believe the hate sell FOX is angling towards before the investigation is over.

Hate crime? Sure why not? If the roles were reversed it would be considered. Let us stick to the facts shall we? A white man driving a truck struck a black child who darted out in traffic. The child suffered a broken leg. The man got out of the truck to check on the child and was surrounded by a crowd of black men (per surveillance video) to the point where he is now in a medically induced coma. This is right how? Not racially motivated how? Give me a break. When people stop burying their heads in the sand and begin to look at these things for what they are then we can have an honest discussion. Until then the apologists will continue to deflect and change topics. The justification of a group of black men beating a white man into a medically induced coma after an accident involving a child which the driver got out of his vehicle to check on after striking him with his vehicle is...........???? Yeah I couldn't think of a rational answer either.
Racism, I could rule it in, but I lean to ruling it out and I'll explain why I assert this view.
The article gives you little details on the driver, injured kid, but zooms in on the alleged beating.
What was the Drivers toxicology report, did the crowd know him to be a regular corner shopper?
Due to Junk Journalism, readers who have no perception of the disappointment of every day urban life will blindly conclude that black Americans have their bootstraps on White Americans and they're all out to getcha,
The proceeding articles paints a clear picture of what the 'Pennlive' is influencing readers to think..

EX: In Newark NJ many children were mowed down and injured or killed by ramps like 78 West that puts you en route back to the $uburbs. %75 of the time, the driver LEAVES the scene for obvious reasons-DRUGS!
Early 90's a 7 year old was killed by that ramp.. Younger witnesses (Playing Ball) got a plate # and a good description of the Driver, Vehicle and gave Police a partial plate #.
The boys parents made a tearful plea for the driver to turn himself in. Police (in a joint effort) expeditiously worked on catching the suspect whom was a young white Heroin user from the burb$.. The young 'suspect' committed suicide shortly before trial..
I'm %200 certain of 3 things.
1. There's a lot of reckless driving, whether it be residents or 'visitors' picking up stash and dashing away.
2. Chances are, this was hardly about the drivers ethnicity, A rowdy bunch get emotional b/c drivers take off.
3. A Black Driver probably wouldn't just get a pass a fist bump from a rowdy bunch of emotional witness's.
The flip side, urban cities now have good surveillance which expedites investigations. Citizens are aware of this, and this group of morons should have entrusted the authorities to do their job and used restraint.
The driver as well as the suspects deserves a full investigation, and proper charges should be assessed with out the influence of opinionated news articles who influence jurors, thus makes our system of justice futile.

From the article, it seems the assault on Mr. Utash would fit the definition of a hate crime.
