YES! Our electronic communications ARE our constitutionally protected 'papers and effects'! The IRS is in violation of MANY protections as unwarranted seizure also has a chilling effect upon free speech!
"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."
Looks like the pressure is on from a number of directions.
I believe this current adminstration has zero respect for the Constitution and will continue with it's backdoor policies to take moe and more of our rights.
Food for thought: it's time to update our privacy laws to the 21st century and draw a clear line so powerful idiots can't trample on our rights. Either that or let's get it to the SCOTUS (as Dave suggested) and get it down as case law.

If I can take this story at face value, I should have some concerns. It seems we live in a generation where erosion of our rights is occurring almost unnoticed. Thankfully generations come and go. I do believe the sleeping giant is awakening. Thank you for the post mz66.
