WOW. In addition to a big check these officers should be charged for sexual assault.
Get the check book out. The agency I work for had a male officer conduct a strip search of a female (alone) at the police station for a speeding viiolation. It was settled out of court for a mere $6,000.00. I was surprised at this low amount.
Unbelievable! I felt violated just having to watch this! So glad I dont live in Texas anymore! They pretty much get "fingered" on the side of the road because the first officer felt like they were acting "weird." If he smelled an odor of marijuana coming from the car, why didnt he search the car? Then do a pat search. IMO- I dont think this stop, or his suspicions rose to the level of a cavity search on the side of the road.
The department will most likely settle to make it go away with out admitting any fault rather then go to trial!
sad situation for a minor misdemeanor drug case that didn't happen!
This is why we have policies and procedures besides the laws and you cannot violate either...
I've been involved in 20 years of roadside patdowns but I've never seen a roadside cavity search. What kind of policy is that? Was there any probable cause to conduct a search rather than a patdown for weapons? There was no reason to believe that marijuana was concealed in the either of the bodily openings so why do it and then not even charge them with anything they were stopped for? Bad policy.
This was not a search incident to arrest, but overall I think there was enough probable cause to get these two out of the car and conduct a search of their person.
