Just to update on this it is now known for sure he is suffering brain damage but it is unknown how much at this time. also he was ejected from his vehicle upon impact with the suspect vehicle.

The suspect could have prevented his own death by pulling over and stopping the car when officers attempted to pull him over. The suspect's mother is in grief and wants to put the blame on anyone but whom is at fault. Her son made the conscious decision to flee from police thinking he could out run them with his racing skills, but in the end he put everyone in danger from the public to the police. Now he is dead and an officer is in a coma. I pray that she finds some peace with what happened but she has to accept that we all make our own choices.

And to the mother of the SUSPECT (NOT the victim, as she claims he was): YOUR SON caused his own death -- NO ONE ELSE...sorry your son thought he should try and outrun the police rather than pull over, but that was his own fatal decision. Guess we can expect another frivolous lawsuit on the horizon, in lieu of the family accepting their son's personal responsibility in this incident. (The perp's mother should pray that the Sgt makes a 100% recovery and not sue the perp's estate for physical pain and suffering caused by her son..)

Sure, the girlfriend may have given him the keys, but if he didn't bring the car back, he has used it out of the scope of intent. In Ohio, that's Unauthorized Use. Georgia may treat it different.
Mom SHOULD NOT blame the Police for the actions of her son and his girlfriend. "Hit him head on in the side". That would be a contradiction. It's not head on if he was hit in the side.
