Union Files Complaint Against Chief Who Made Off-Duty Arrest

On that day, Chief Duffy said he was not scheduled to work but decided to check on citizen complaints about possible drug activity in a part of West Scranton.

While driving through the area, he arrested a man who had an outstanding bench warrant issued by Lackawanna County Court. The chief also searched the man and allegedly found he possessed a marijuana joint and drug paraphernalia, leading to the man’s arrest on drug charges.

Sgt. Martin acknowledged that the chief is “morally and legally obligated” to act if he sees a crime happen and to make an arrest if necessary.

But, the union president said the chief, as member of management, should not actively root out crime or randomly patrol neighborhoods while off duty because it violates union agreements that protect rank-and-file officers’ employment. The union is concerned city administrators will have more leverage to lay off police officers because “Chief Duffy will step in” and do the work, Sgt. Martin said.

“It’s a perception and it leads to that,” he said. “We’re threatened with layoffs.”

The union is asking an agreement be drawn up about the chief making the arrests.

Chief Duffy said he will not stop patrolling neighborhoods or making arrests if he receives reports from citizens, whether on or off-duty, because of the complaint.

“It’s not like I am getting the information and keeping it to myself and playing hero,” the chief said. “I will continue to do this. I’m a public servant.”

On March 20, while not on duty, Scranton Police Chief Dan Duffy decided to take a drive through West Scranton, following up on complaints about drug activity. He saw a man he had arrested before walking on Division Street, according to arrest papers. Chief Duffy ran his name, confirmed there was a bench warrant issued for his arrest, and pulled him over. “I consider myself always on duty,” Chief Duffy said at the time.

    How Stupid! I guess they not real police up there! How Petty!! No wonder this country is in such a mess with dumb liberal thinking like this, good grief! I belonged to a idiot union, they never did squat for us but take our money! They should be disbanded, now they sound like the worthless ACLU.

    This is complete horses()*^ . You gotta be kidding me Cops complaining on Cops doing Cop work. UNBELIEVABLE. Those guys better be glad I don't work there. If these guys want him to ignore his oath than that tells me that they are willing to ignore theirs and they are the ones who don't need to be out there. Either your a cop because you truly want to make things better or your not, and if your not we don't freakin need you.

    .......and at least the Chief is more concerned with doing his job than worrying about not getting paid for every move he makes doing what he swore an oath to do. Sounds like a good cop to me.

    If the union is in place for the good of it's members it would have to boot all involved in an action this rediculous. The Mayor needs to grow a pair. It's time to send all of those that run our political system back to the private sector and replace them with people from the working class that know how to do a job well. This kind of garbage just blows my mind.

    RnG78.......maybe I'm missing something here but what has this action got to do with the Chief being on the mayor's shit list? If I read the article correctly, the city is part of the grievance BY the union, not WITH the union. The chief and the mayor are on the same side here.......unless I don't understand the written English language. The mayor didn't bring the action....the union did. Dumbass readers.

    This is truly a JOKE....Any officer regardless of rank has sworn an oath, union or not, your sworn to protect and uphold the law...and the union wants only certain officers to do their job?.....Think this Union should back off and let this dept. do their job......I can't even believe that this is really happening

    Truly sad. When I was Chief of a small Department, I was the follow up investigator, frequently primary officer if we got backed up, adminstrator and secretary. I generally did all the jobs and I basically expected my officers to do the same. I was an LT in a larger department but even as an administrative officer I had more DUI arrests than the patrol LT's. Even my Chief of that dept made arrests. This is the most pathetic grievance I have seen, and I have seen a few.

    First and foremost i don't work for a union and i have no real desire to, i respect and appreciate what they 'Have' done for the workers of this country but i believe they are in their twilight years, the world has changed and the labor unions want to hold on to the same power scheme they had in the seventies.

    Just as one bad officer gives the entire profession a bad name, one bad Union Rep gives all unions a bad name, poor decisions lead to a loss of faith.

    Sorry for the ramble, moving on now.

    Turf war by a police union?! This mentality hurts police officers and what hurts them will ultimately hurt the people they're sworn to protect. This is some twisted logic and it's the sort of thinking and event that turns people against unions. Glaring classic example of counterproductive action...still shaking my head. The bad guys love this kind of stupid.

    This is the most twisted logic I've ever read on the part of police officers' union. This sort of maneuver is what turns fence-sitters against any union activity...it's unreasonable, nothing more than a turf-guarding mentality that will ultimately hurt officers and what hurts them ultimately hurts also the public they are sworn to protect. Unbelievable.

    This is one of the dumbest actions ever taken by a union. You should lose your agreement over this. You are the people giving unions bad names. My god, pull the bullet out of your pocket and a be cops.
