Union Files Complaint Against Chief Who Made Off-Duty Arrest

Scranton, Penn. — The Scranton police union has filed an unfair labor practice complaint against the city for an off-duty drug arrest made by Police Chief Dan Duffy in March.

The complaint, which was filed with the state Labor Relations Board on April 14, takes issue with the chief arresting a man who was allegedly in possession of marijuana because the chief is not a member of the collective bargaining unit and was “off duty” when the March 20 arrest was made.

“I think it’s absurd. I’m not going to turn my head on crime that takes place,” Chief Duffy said. "I took the same oath (as a police officer) that everyone else took.

“On my day off and I’m driving around as the police chief, and that’s wrong?” he asked.

The complaint states that “the work of apprehending and arresting individuals has been the sole and exclusive province of members of the bargaining unit,” and that the city did not inform or negotiate with the union that the chief would be “performing bargaining unit work.”

Because of this, the union says the city violated the state Labor Relations Act and the Policemen and Firemen Collective Bargaining Act.

“We’re not out to bust his chops,” Sgt. Bob Martin, police union president, said. “It’s not against the chief. The action is against the city.”

Mayor Chris Doherty declined to comment on the matter Monday.

While the chief has been known for several off-duty arrests in the city, the complaint only makes mention of the March 20 incident.

    They must reeeally hate that guy, because that has got to be one of the most RIDICULOUS grievances I've EVER heard of. I'm a union supporter, but I'm going to have to call foul on this one. The man is a cop, like it or not. While we all don't know the details, I can tell you this.....Your union leadership has just made you guys look really petty, and stupid. Good job Chief!!

    This is a reason why there is so much anti-union animous lately. As a former union rep, I would not have touched this in a grievance. There has to be more to this story than what they are reporting. Union or not, the chief had an obligation (morally and legally) to take action.

    And then we wonder why we are having problems with unions laytely..................Cmon guys fight the ones that need fought. The Guy is a cop. I was a Chief for 15 years and made hundreds of arrests on and off duty. Go find a bad guy to arrest instead of spending time on this crap

    if a crime was being committed in the police chief presents, he has not committed any crime by acting, because he is no different than any other sworn officer, other than being classified as the department head, so he is justified in his actions in my opinion and should be left alone............This is why the world can't control crime these days. too many people stick their nose in places that they really don't belong and blow things out of proportion..........I say this in no offense to anyone, but as my opinion only, so if it offends anyone, I do apologize........

    This is absolute idiocy! What a complete screw up! This is the Union mindset, you can only do the particular job that you are assigned to and nothing else and never unless you are 'on the clock' as you much call someone who is actually on the clock or call someone in for overtime etc, etc. These Unions have ruined so many businesses in this once great nation including the Steel Industry and the Automotive industry and yes even teachers and now they are working on Police Officers. The Unions can go pound sand as far as I am concerned. I for one applaud the Chief for taking action when he saw a criminal act taking place. I like a Chief who has the Gonads to work the streets when necessary!

    obama care, not applicable to auto union members.

    With whatever else may be going on between the city and the union aside, I tip my hat to the Chief(any Chief for that matter) who still does police work. I am sure the Union president could something else better in which to focus his attention. On the surface, this looks horrible!
