FL Jogger Won't Be Charged For Shooting, Killing Teen
Associated Press
January 13, 2011
TAMPA, Fla. (AP) – A pistol-packing jogger in Florida won’t be charged for shooting and killing a teenager who attacked him during a midnight run.
Prosecutors said Tuesday they are convinced Thomas Baker acted in self defense when he fired eight shots at 18-year-old Carlos Mustelier near Tampa in November .
Prosecutors say Florida’s “stand-your-ground” law was a factor in their decision. The law, passed in 2005, gives people the right to use deadly force as long as they “reasonably believe” it is necessary to stop another person from hurting them.
Baker told police he reached for his gun when the teen punched him in the face. Baker has a concealed weapons permit.
The teen was hit four times in the chest, back and buttocks. He died at the scene.

Good shot placement. I am sure the teen was a model citizen.LOL. The teen at least won't be a career criminal. Good job Baker. 1baggdHD. Relax everything is fine. Shoot to kill as an wounded person is still dangerous.

I love Florida! A citizen does not have to back down or retreat when they feel they are in harms way! Get those CCW permits asap, but let LE know your packing if an encounter occurs between you and them.

Good for the jogger for standing up and defending his self. Let this be a reminder to all criminals....You never know who is carrying a gun.

Good on ya... Perfect use of Concealed Carry permit... Let the thugs be reminded that their next target may just target them back with deadly force

I just wish we had more states with laws set up like this that gives people more rights to protect themselves. If there was more news of things like this happening maybe the criminals would get the point.

Sounds like 1baggedHD is going to suffer the wrath of everyone on this site. One shouldn't make comments without something (training or experience) to back up the opinion. Any cop knows what many on this thread have said...if you have reason to use deadly force, you shoot center mass to make sure the threat stops. Nothing more...nothing less. It's midnight (that means dark)...does anyone think that aiming for an arm or leg is going to be effective? Let's get real folks!

High risk behavior does come with consequences. The jogger may well have been horribly injured if he was not carrying.

Seriously 1baggedHD? Great job protecting yourself, Mr. Baker. Prayers to the teens family. Sad situation.

Lol....it is ridiculous to shoot an adrenaline pumped teenager in the leg and expect for him to go down. The teenager should have picked up a different profession before he decided to go after this particular jogger...which prepared in advance not to become a victim himself.
1baggdHD- If you decide to shoot a perpetrator in the leg when your alone in the woods/side of the road with no help in sight....then do it and but I speak for my self when I say... always shoot center mass when in a deadly force situation.
