Sheriff's Captain Charged With Rape of Former Inmate

MONROE COUNTY – We have our first video of the Monroe County Sheriff’s Office Captain accused of having sex with a former inmate. The video shows Catherine McLaughlin walking out of court with her attorney and a friend. McLaughlin is wearing the dark colored jacket.
McLaughlin is charged with 3rd degree rape, official misconduct and inappropriate use of a computer. She is accused of having sex with a former inmate in the Monroe County Jail. Because inmates cannot legally consent to have sex with anyone who works in a jail, the crime is rape.
McLaughlin’s attorney, public defender Erik Teifke, declined to talk on camera. But he offered McLaughlin’s side of the story.
He described the victim in this case, Joe Miller, as a “career criminal.” He said McLaughlin would give Miller some special privileges, like making a phone call, to ease the tension in the “pressure cooker” inside the jail. Teifke said when McLaughlin stopped doing this for Miller, Miller got upset, went to the sheriff’s office internal affairs and made the allegations.
Miller testified in the grand jury against McLaughlin and shortly after that the charges of armed robbery against him were dropped. The District Attorney’s office still has the option to re-file the charges.
McLaughlin is back in court December 12th. She is released with no bail.
McLaughlin was suspended without pay in September.

If she's guilty, shame on her. If she is not guilty, I hope the D.A. goes after the POS iinmate for filing a false police report and reinstates the armed robbery charges, as well. Bump retleo.

But, why would Armed Robbery charges be dropped for his Grand Jury testimony whether true or not? Let's see which is a more serious crime, Armed Robbery or Sex in Jail? Something not being said here and I'm not ready to condemn the Captain just yet...

I am always amazed when I hear about jail personnel (COs, SOs, etc) engaging in such activity with inmates. What part of the descriptor "Inmate" is fuzzy and/or unclear to these people! Inmates will be your buddy as long as they are getting something from you, when the giving stops they always run to the Admin and report you. When is this message gonna get through their thick skulls!

I agree with Jensen, 'If' she is guilty then shame on her and fire her. While I can understand that an inmate cannot give consent to call it rape would be really reaching. No way could she force him to have sex with her. No matter what, they POS should still be held accountable for the Armed Robbery.
Interesting legal note. The wording of rape is 'penetration of any depth'. So how did she penetrated him unless she shoved an object up his butt? A female is not capable of raping a male unless she sodomizes the male, is she?

This happened in my area. The Sheriffs Office and DA are being very tight lipped. I do know that the rape charge is because the law says an inmate cannot give consent so it appears it may have been consensual.Just because he is a male and she is a female doesn't make a difference in that case. I am interested on what they found on the computer for the charge improper use of a computer. It will be interesting as this all plays out.
Forgiven85, I'm not sure what you mean by a higher up in the chain of command may have made a mistake, unless you're making a joke because she is the high up in the Chain of command since she is a Captain.

There's definitely more to the story than what the media is sensationalizing. It will be interesting to see how this plays out. I highly doubt the DA would have proceeded forward with charges on just this dirt bag's statement without some type of evidence. And the Sheriff's IA wouldn't have suspended her and forwarded the case to the DA without something actually there. Like I said, it'll be interesting to see what happens.

To call it rape is beyond ridiculous and a waste of resources. It's still unfounded, and if evidence supports it, or she is found guilty, fire her. End of story.

Let it all play out.........Consider the the source of information!!!!!! A public defender????? I thought that a person needed to be indigent, and or needy no job etc...I'm just saying !!! These types of case require a lot more then what I'm reading so there must be a lot not being disclosed or the DA'S office is incredibly stupid !!!!!!
