TX Officer Charged in Stealing Guns, Evidence

BEAUMONT, Texas — A former Houston-area police officer has been charged with federal firearms violations after he allegedly kept weapons illegally that had been confiscated as evidence.

Prosecutors accused Harry Leroy Kelley of stealing more than 100 guns while in charge of the police evidence room in Cleveland, 45 miles northeast of Houston. They say Kelley, now a 55-year-old Liberty County sheriff’s captain, falsely reported that he had destroyed the guns during a 17-year period with Cleveland police ending in 2009.

Kelley is charged with 103 stolen firearm counts and other charges.

Defense attorney Jack Zimmerman said Kelley pleaded not guilty Thursday and was released on his own recognizance. Zimmerman said Kelley “didn’t commit any crime.”

A Liberty County sheriff’s spokesman says Kelley has been placed on unpaid administrative leave.

    At first I thought, "Wow, this guy was BUSY!" Averaging about than six guns a year for seventeen years, "What ELSE did he steal?" is a great question. The guy knew how to cover his tracks. Annnd... I'll bet there's a LONG list under "What OTHER crimes did this man commit?"

    If what I have heard is correct he was selling the firearms to fund ammunition for his department. He thought it was all above board. It sounded more like a paperwork error that the feds got ahold of an ran with.

    I have said it before and I will say it again. This is not a LEO this Subject quit being one the moment he turned dirty. This Subject is not an embrassment to me cause he is not like me he is trash for not being any better than anyone else who commits a crime.

    WOW!! That is why our department has a policy pertaining to this. Two officers must witness evidence being destroyed with an independent third witness verifying. What a shame!!
