Sheriff's Deputy Charged In Arrest of Fire Captain

LEADVILLE, CO – A Lake County deputy who jailed a Leadville fire fighter last month will face charges.

Deputy Steven James jailed Leadville Fire Captain Dan Dailey March 27 when Dailey responded to a medical call to treat a domestic violence victim who was being interviewed at the jail.

According to court documents obtained by 7News, James faces charges of impeding an official in a public building, official misconduct and obstructing a fire fighter or medical person. All three are Class II misdemeanors.

James is scheduled for his first court appearance on May 10.

According to the Denver Post, District Attorney Mark Hurlbert, chose to file no charges against Dailey.

Sheriff Edward Holte said on March 27, a woman went to the Lake County Sheriff’s Office with her children to file domestic violence charges against her boyfriend. Holte said his deputies called for an ambulance to examine the woman.

“We did an ambulance only page, which means only the ambulance is supposed to respond,” said Holte. “It was a non-emergency response. All we needed was medical people to be on scene to take a look at her and let us know exactly where she was at and what kind of condition she was in.”

Holte said the fire department responded on its own will and arrived moments before the ambulance. Holte said James told the captain the fire department’s services were not needed and asked him to leave. When Dailey refused, James handcuffed him and put him in a cell.

The district attorney launched an investigation into the incident the following Monday.

Mayor Bud Elliott and Fire Chief Bob Harvey said this incident stems from an ongoing dispute between the sheriff’s office and fire department.

“It is reprehensible,” said Harvey. “This is what we are all about; being there to render aid to assist and care. So as far as I am concerned this could have been more appropriately handled had my crew been allowed to begin the basic life support procedures and then taken care of it later. This was not the appropriate time, place or event for these issues to come out.”

Dailey did not want to comment on the charges filed against James when reached at the fire house Wednesday evening.

The sheriff was unavailable Wednesday night.

    When i called the ambulance after my mom collapsed a cop showed up minutes before the ambulance..i guess i should have ordered him off my property as his services weren't needed.

    Come on guys do not make situations from the TV program Reno 911 a reality. In the program the Firefighters keep owning the Sheriffs Dept.

    I'll be honest, a lot of municipalities fire and police are always in a peeing contest. In most circumstances the police are paid more than the fire fighters. At least that's whats going on here locally. From the story above, that's just ridiculous. But, as always there is more going on here.

    So the SO requires all of its deputys to be EMTB and IV certified in this county and it all stems from the SO wanting to take over inital medical response and summon additional medical responders as nessasary (i.E. to transport in a amblance and not a police car) from a contracted FD so they can "save money for the city" thus rasing the budget of the SO and heck who wouldnt want better equipment exceptionally when your in a "small" county enviroment that is under funded to begin with

    I wonder if FD was dispached.. Around here they are sent on most medical calls because they are trained to the same level and sometimes higher then the ambulance people.
    If the person needed to be evaluated the FD could do that and would be able the keep the ambulance inservice.

    In the many years I worked, the only issue between LE and FD I can recall was the FD occasionally blocking roads with equipment at wrecks that were not on the road (interstate where there was an emergency lane for parking). The brass got together on it & problem solved. We had a great working relationship. It's sad to see the good guys going at each other like this.

    Fire fighter = medical personnel in most places in this country.

    Stupid. The Sheriff's Office and Fire Department need to work out their stupid issues and move on. Geez. We're all adults here, right?

    This is absolutely wrong. Not a good decision on the officers part........these 2 depts need to have drinks. I mean, I think every PD and FD butt heads but I can't see myself arresting and throwing a fire captain in jail.....not cool.

    Obongo needs to get all the deputies and all the firefighters together and sit down and have a beer. I'm sure this would solve all the problems!

    The problem could be about budget issues, I have a friend who works for an other small agency in Colorado. His department was told that they couldn't get new cars but the money was found to get the FD a new truck. Who knows but come on who do they think is going to show up to help them if the sh*t hits the fan.
