FBI to Review Shooting After Officer Cleared by Prosecutors

FAIRFAX, Va. – The FBI will review the shooting of an unarmed Fredericksburg man who was killed during a Fairfax County police chase.

David Masters, 52, was killed in November at a Richmond highway intersection after he refused to pull over for police, who were chasing him for allegedly stealing flowers.

Fairfax County Commonwealth Attorney Ray Morrogh, who cleared the unidentified officer of any criminal charges on Wednesday, says he’s confident the FBI will come to the same conclusion.

“That’s a good thing” Morrogh says. “Another level of assurance for the public that they can trust their public officials and these matters are handled fairly and they’re looked at without bias.”

Morrogh says the FBI review isn’t routine, but it’s not rare, either.

Masters had a history of mental illness and police believe he was reaching for a weapon after he struck a police officer with his SUV.

The police officer is a six-year veteran of the Fairfax County force.

There were no witnesses to the incident. Morrogh says he found no evidence of malicious intent or recklessness.

Gail M. Masters, David Masters’ ex-wife, says she’s disappointed with Morrogh’s decision.

Since 2005, nine people have been killed in Fairfax County police-involved shootings. Twelve people have been wounded.

“I believe a federal judge made a comment recently in one of those cases that it isn’t an alarming number given the population,” Morrogh says.

Fairfax County’s population is just more than one million.

    Why is the FBI investigating a case already cleared by the local DA's office. If thats NOW there NEW thing, then investigate all police shootings. Why should this officer and his family have to sit through another investigation. Thats PURE B.S.

    Think not that the FBI is above being influenced by political pressure or public opinion. It isn't. They will open cases just because some do not agree with conclusions reached by the local authorities, regardless of the known facts.

    "cf6k14" While I do understand your frustration, the FBI still has an obligation to investigate beyond the normal state level. Because in some caseses, the surviving family members may claim "Civil Rights Violation", Espcially if the perp was a person of color. I just wish the best for this Officer's outcome.

    I just got to wonder why the FBI is involved when the officer was cleared by the DA. IT don't make sense. The only thing I'd be worried about is a civil lawsuit and getting my butt back to work. I hope this officer is cleared of any wrong doing by the FBI. Another case of the Federal Goverment sticking their nose in the States' business. Hope all goes well for this officer.

    I hope that's the case. They also become involved when politicans don't like the outcome, even a jury verdict.

    I believe it was a justified use of force; therefore, is ok with me...
    Since he was already clearly by the DA after their investigation, I don't see any further issue...

    Please... Be advised that DA's sometimes bring in the FEDS themselves, in order to have a fool-proof air-tight case.
