Supreme Court Overturns Ruling that Nullified Death Penalty for Cop Killer

Philadelphia – The Supreme Court on Tuesday threw out a ruling that had set aside the death sentence of Mumia Abu-Jamal, convicted of killing a Philadelphia police officer in the 1980s in a racially tinged case that has made the former Black Panther an international cause celebre.

The justices ordered the U.S. 3rd Circuit Court of Appeals in Philadelphia to revisit its 2008 ruling that Abu-Jamal deserved a new sentencing hearing because of flawed jury instructions.

The Supreme Court pointed to its decision in an Ohio case last week, when it said a neo-Nazi killer did not deserve a new sentencing hearing on those grounds.

A mostly white Philadelphia jury convicted Abu-Jamal of killing white Officer Daniel Faulkner in 1981.

Prosecutors think Faulkner and Abu-Jamal exchanged gunfire after Abu-Jamal’s brother was pulled over in a traffic stop. A wounded Abu-Jamal, his own gun lying nearby, was still at the scene when police arrived, and authorities consider the evidence against him overwhelming.

But he maintains his innocence. Since his conviction, activists in the United States and Europe have rallied in support of his claim that he was the victim of a racist justice system.

The issue over jury instructions relates to whether jurors understood how to weigh mitigating circumstances that might have kept Abu-Jamal off death row.

Typical Liberal Media spin to incite a perception of there being a "Racist" tinge to the jury. If you have studied the FACTS of this case at all you will know that a jury of any race, creed, religion, color, ethnicity, or sexual preference would have convicted Mumia of the murder of Officer Faulkner. The fact that Mumia has become the "Darling" of the Liberal Hollywood Nut-jobs does not detract from his guilt or the need to move forward with his execution. Kudos to the Supreme Court for not bowing to the liberal hype about this POS and for overturning thge lower court's ruling. Now......lets get on with sending this Turd Mumia to his rightful place in HELL!

    I have been following this case for years and this is good news. The officers widow has done a wonderful job of keeping this story in the public eye and letting all of us know which TV stars and ice cream makers to boycot. I give her a lot of credit.

    I worked in a state prison for 5 years. Its not justice for him. 6 yrs ago it cost(in Ohio) $26,000 a year per Inmate. What a waist of money..

    This is finally some good news in this case. This case has been plyed around with for far to long, with to many Hollywood types getting involved just to try to make a point that being a star in movies means your better than the general public and that you have the right to try to minipulate the system and the people due to they're stardom. Now after all these year he may get what he deserves, which is put to death!

    Lets just hope that when the Court of Appeals does revisit their ruling they do the right thing. Hopefully, they aren't like NY States Appelate Courts, who did away with the death penalty. I hope he gets whats coming to him. I have boycotted Ben and Jerry's ice cream ever since learning of their supporting this POS.

    Well... I hate the Black Panthers and everything the stand (or stood) for. I have a profound comtempt for their so called "cause" and their activities as I remember them as a young man in Brooklyn back in the 70's..
    I hate any racially-based organization.
    I hate any dogmatic doctrine based organization
    I hate any radical organization of any kind.
    Any group... Ethnic, racial, religious, or otherwise that advocates violence -specially against LE- is dogmatic, narrow-minded, selfish, and just plain STUPID. The Black Panther fits that description perfectly, just as the KKK...
    Besides, I remember this case well...
