Witnesses said Mosley was behaving strangely, breathing loudly and almost growling as he was standing there. Several employees had recognized him as the man who previously robbed the bank.
Moore came up behind Mosley and asked him to show his hands. A scuffle ensued, during which Mosley pulled a gun from his pocket and the two men crashed through a window.
Five shots rang out and Moore, who was wearing a bulletproof vest, never got up. Mosley was trying to run away from the bank when another Garland officer shot him in the wrist. He was taken into custody without incident.
Moore was airlifted to Baylor University Medical Center, where he was pronounced dead. He was 32 years old and had served nearly 10 years on the Garland force.
At a weeklong trial later that year, Mosley would argue that he was simply trying to hand over his gun when it fired five times. The shooting was accidental, he insisted.
But the jury didn’t buy it and found him guilty of capital murder after deliberating only 45 minutes. It took half an hour to decide on the death penalty.
Jason January, the Dallas County prosecutor in the case, recalled watching the bank’s videotape of the skirmish and said what happened was as clear as day.
“The officer gave Mosley every chance to give up peacefully,” said January, who is now in private practice. “David Moore was as professional as he could be.”
That memory makes it easier to accept Mosley’s execution by the state, January said.
“If I was a family member watching Mosley die, I would be thinking about the terrible thing that he did to a police officer,” he said. “It didn’t have to happen that way.”

13 years is a long time to get closure but it is a lot shorter than most states. I know the last guy we executed in TN, he was in prison for over 25 years. That is ridiculous! I agree with all of my fellow PL members here, finally, it is time for some closure. And it is time for this scumbag to answer to God for what he did 13 years ago!

It's a damn shame that they had to wait for 13 years for justice to be served. Lethal injection is just way to kind for people like this. I like the electric chair for them or firing squad. Also they should never learn their date of execution until they come and get him. That way they will damn sure make their legal appeals on time! Also it is nice to know that they will always wonder if today is the day the guards show up at his cell door with a smile on their faces.

I gotta say i'm not happy about the lethal injection...I'm a fan of a simple .40 to the head...it's cheeper

Gotta laugh at the POS's excuse...he was handing the gun to this hero Officer and it accidentally went off...well today the needle won't accidentally shoot the lethal injections it will do it purposely. It is about time the Officers family including his family in blue get to see this scum receive what is due him. I only wish NY had the death penalty.

What a shame that he got to live another 13 years. Although Lethal Injection is a cowards way out, and he should have the GARY GILMORE METHOD of FIRING SQUAD made up of The Family Members of the Fallen Officer, but we can only wish, nevertheless he will be DEA and that will give Mrs. Moore and her children the closure she needs. For all the Officers, Friends and Family members that rallied around her Im sure she appreciates that more than words can say. May God Bless you and your Children in this time and now Officer Moore can RIP...

Your right fplasencia. . . but lethat Injection come on. I think we need to bring back the chair for Cop Killers. I know one of the bank employees that worked there & she still has nightmares about it.
Hopefully this brings closure to his family.

13 years is a long time. A lot of time... Time this scum bag didn't give to Officer Moore 13 years ago..
But, I still have to give the State of TX a lot of credit: They will fry him, sooner or later... Much better than some Liberal ruled States that will never execute a Cop killer.

Why is he still breathing? It shouldn't take this long to execute anyone.
