Cyclist Suing NY Cop For Hitting Him With Patrol Car

BRONX, NY – A Bronx bicyclist is suing the NYPD claiming a reckless cop hit him with a car near the Macombs Dam Bridge.
Michael Molina was cycling last April 25 when officer Patrick McKenna hit him with a patrol car, according to the suit filed Monday in Bronx Supreme Court.
Molina suffered from a number of scratches and bruises in the incident, his lawyer, Robert Mijuca, said.
“He’s doing okay now,” said Mijuca.
McKenna was driving at an unreasonable speed and failed to brake properly before Molina was struck, the suit says.
The bicyclist is suing for an undisclosed amount.
“We have not yet received the legal papers, but will investigate the incident,” said Connie Pankratz of the city’s Law Department.

Once again another person trying to get a free pay check. Accidents happen and in my expierence bicyclist abuse the lanes they are supposed to be in.Be a man brush your self off and let the police do ther work.

I was born and raised in NYC. A few years ago I left for the military, now that I've moved back I noticed cyclists have their own special lane and traffic lights in Manhattan. I never see them follow those traffic lights or stay in the land that has been designated for them. They believe that since they don't have an engine that the traffic laws don't apply to them.

Like to see the police accident report. Like coshane220 says: What was the bicyclist doing? What was the police car doing? What were the road, weather and traffic conditions? Did the cyclist receive or decline EMS? Did he decline an accident report and just now, eight months later, decide to throw a lawsuit? If he declined all that it's his word against the officer's. Sounds frivolous from the information given. What are the chances of finding a judge in NYS that will toss it as gratuitous and without merit? ;-)

Please carry on investigation. NYPD is no place to have to bother with friviolous lawsuits. Don't let a precedent start here! Cyclist in some areas think they own the road. Some even out there to make money!! Check it out and it seems to me if unreasoable speed were involved at the time of the "bump' this guy would have more serious complications that a few bruises and scratches..Give me a break!
