The 287(g) Program: Protecting Hometown and Homeland

The 287(g) program was created by Congress to allow state and local LEAs to participate in the removal of illegal aliens, under supervision of ICE. There are now more than 70 LEAs participating, and more than 100,000 illegal aliens who committed other state or local crimes have been identified. Agencies report that the program has helped increase the removal of criminal aliens, reduce crime connected to illegal immigration, and save scarce criminal justice resources. This report examines the 287(g) program’s history and its status. We interviewed participating LEAs, reviewed statistics and reports they provided, analyzed data provided by ICE through a FOIA request, and scoured news reports on the program. We conclude with a discussion of recent Obama administration adjustments to the program and present several recommendations for improvement.
