RICHMOND, CA – The 911 dispatcher asked if there was anyone around the naked girl, lying in a dark courtyard on the Richmond High School campus.
“People have passed by there, have been seeing her, but nobody wants to call the cops, so we decided to call,” Margarita Vargas told the voice in the phone the night of Oct. 24.
“Um, they say she looks like a ninth-grader, like about 15, 16 probably.”
So began the investigation of a homecoming-dance gang-rape that shocked the nation two weeks ago, one that continued Thursday as three youthful defendants stood before Contra Costa Superior Court to answer hard felony sexual assault charges as adults.
The suspects — 17-year-old Marcelles Peter, 16-year-old Ari Morales and 15-year-old Cody Ray Smith — all potentially face life sentences if convicted.
“My client is nothing more than a young kid. He has two loving, hardworking parents who support him,” said attorney Ernesto Castillo, who represents Morales. “For me to appear here today in Superior Court … it is troubling for me to dealing with this case in adult court.”
Smith pleaded not guilty at a hearing last week. Morales and Peter did not enter pleas. A fourth suspect, 19-year-old Manuel Ortega, also appeared Thursday but entered no plea. Judge Peter Berger ordered all to return next week, after defense attorneys receive additional information from the prosecution.

Prayers for this young girl who will need support and will to overcome a life changing event, such as this. Parents, be involved and know your kid's friends. This is very sad and I hope these "boys" receive a man's sentence.

Well, attorney Ernesto, you know you're in the big time when in the Superior Court. If you have trouble 'dealing' with it - resign. The 'young kid' can get a decent lawyer and stop a potential re-trial for having an incompetent attorney represent him.

Thank you Ernesto Castillo for clearing up the fact that your client is nothing but a "young kid". This guy needs to get a clue and realize that "young kids" are extremely capable of commiting some pretty nasty crimes. I guess because he is a young kid all is automatically forgiven and we just ignore the evidence. I can't stand idiotic defense attorneys like this guy

The fact that this terrible crime took place is sickening enough but the fact that people just kept walking by and did NOTHING is the thing that really frightens me about what our society is coming to. It's disgusting. Gut wrenching want to skip your lunch disgusting. And the attorney flapping his mouth about "young boys", well those boys stole a very valuable part of that young ladies life that she will have to try and live with forever but never get back, they don't deserve pity. They're animals pure and simple.

I am really grieved that this happened this young girl. I too hope she gets all the care and help she needs. As for the participants, clean em and fry em! As for this so called lawyer, Ernesto Castillo, hope he don't end up in a room with me any time soon! By the way, any lookeeloos should be cleaned and fried too. That IS accessory, isn't it?
